You’re living abroad and received news that an FIR has been filed against you in India. Maybe it’s a property dispute with a relative. Maybe it’s a matrimonial complaint from an estranged spouse or in-laws. Maybe it’s a business matter that has taken a criminal turn. Whatever the situation, the distance makes it harder — and more urgent.
Adv. Akash R. Chikate handles criminal matters for NRIs at the Bombay High Court and Pune Sessions Court, including remote consultation for clients based abroad.
The Unique Challenges NRIs Face in Criminal Cases
Criminal cases in India become significantly more complicated when the accused is overseas.
Arrest warrants and Look Out Circulars (LOC). If police obtain a Look Out Circular against you, your name is flagged at all Indian airports and ports. You could be detained the moment you land in India for any reason — a family wedding, a medical emergency, a property transaction. Getting an LOC removed requires an application before the appropriate court, which takes time.
Warrants for non-appearance. If a summons has been issued in a criminal matter and you haven’t appeared, the court may issue a non-bailable warrant (NBW). This converts your status from “accused” to “wanted” in the Indian legal system, and makes the situation significantly harder to manage.
Property attachment. In financial or matrimonial matters, courts sometimes order attachment of property during proceedings. NRIs with Indian property are particularly vulnerable.
Inability to attend hearings personally. Indian courts generally require the accused to be present at hearings. An experienced lawyer can apply for exemption from personal appearance (EPA) in appropriate cases — but this must be handled proactively before a warrant issues.
Time difference and communication. Managing a criminal case from the US, UK, UAE, Canada, or Australia across time zones, with paperwork that moves in physical copies, requires a lawyer who is responsive and organised about remote client management.
Common NRI Criminal Matters Handled
Matrimonial-origin FIRs (498A / 85 BNS)
The most frequent category. An estranged spouse or her family files a complaint of cruelty or dowry harassment after the NRI husband returns abroad. The FIR can result in arrest if the NRI returns to India without legal protection in place.
Property and succession disputes turned criminal
A property transaction goes wrong. A relative files a cheating or fraud case. What started as a civil matter becomes a criminal case when someone files an FIR under IPC S.420/318 BNS.
Cheque bounce matters
Business dealings in India, a payment dispute, a post-dated cheque that bounced — Section 138 NI Act is a criminal matter and notices issued under it require timely legal response from India.
PMLA / financial crime investigations
NRI business people and investors in India are sometimes named in Enforcement Directorate (ED) or economic offence investigations. These require immediate representation.
Cybercrime FIRs
Online transactions, social media disputes, or business communications can generate cybercrime FIRs under the IT Act. Distance makes these harder to respond to without local counsel.
What We Can Do for NRI Clients
Immediate status check. We determine the exact legal status: Is there a warrant? Is there an LOC? What sections are invoked? What court is handling the matter and what stage is it at?
Anticipatory bail before you travel to India. If you need to visit India and fear arrest — for a family event, business trip, or property matter — we apply for anticipatory bail at the Bombay High Court or Pune Sessions Court before your travel date. You land with legal protection.
FIR quashing petition. If the FIR is false, malicious, or lacks prima facie basis, we file a quashing petition in the Bombay High Court to have it cancelled. Courts regularly quash FIRs in matrimonial and property disputes where allegations are general and unsubstantiated.
Exemption from personal appearance (EPA). Where Indian law allows, we apply for exemption so your case proceeds without requiring you to fly to India for every hearing date.
Look Out Circular removal. We file appropriate applications to have an LOC removed or suspended so you can travel freely.
Court representation in your absence. Adv. Akash Chikate appears in court on your behalf, keeps you updated after each hearing, and advises on next steps over call or WhatsApp.
Remote consultation. Initial consultation is available over video call. Documentation can be exchanged electronically. We understand that flying to India for every development is not practical — and work accordingly.
How the Remote Client Process Works
-
Initial consultation — over video call or WhatsApp voice call. You explain the situation, share any documents you have (FIR copy, summons, legal notices received). We give you an honest assessment of the legal position.
-
Matter assessment — we check the court records, FIR details, and current status of any proceedings in Pune / Maharashtra.
-
Strategy discussion — we recommend the right course (anticipatory bail, quashing, EPA, or a combination) and explain timelines and what to expect.
-
Execution — we draft and file applications, appear in court, and keep you informed after every hearing.
-
Resolution — whether that’s bail, quashing, or conclusion of the matter, we see it through to a defined endpoint.
Frequently Asked Questions
Can I get anticipatory bail without coming to India?
Yes. Anticipatory bail can be applied for in your absence. You provide a sworn affidavit (which can often be sworn before an Indian consulate abroad or notarised). The lawyer argues the application in court. If granted, you will be protected from arrest when you do enter India.
What if there is already a warrant against me?
A non-bailable warrant needs to be addressed urgently. We file an application to surrender before the Magistrate (which is controlled and safe when done through counsel) or seek a stay of the warrant from the Bombay High Court, depending on the situation.
I haven’t been to India in years and don’t know the current status of my case. What should I do?
This is common. We run a check on your name in the relevant court’s case management system and obtain a current status. We can usually tell you within 24–48 hours what the exact legal position is.
Can the matter be handled entirely without my coming to India?
Depends on the matter type. Anticipatory bail hearings, FIR quashing, and most preliminary proceedings can be handled without your physical presence. Trial matters eventually require attendance, but trials take years — and we can apply for EPA during that period.
I’m based in the UAE / UK / USA / Canada — does that matter?
No. Time zones are a scheduling issue we manage. The legal process is the same regardless of where you are.
Talk to Us Before You Travel to India
The worst time to learn there’s a warrant against you is at the airport. If you have any doubt about a pending criminal matter in India — no matter how old or uncertain — a consultation before your travel is worth an hour of your time.
